1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and The Body Shop Crash Repairs ("we", "us", or "our"), concerning your access to and use of our website as well as any other media form, related services, or offline repair services provided by us.
2. Estimates and Quotations
Any estimates provided via our online "Damage Check" tool, email, or over the phone based on photographs are provisional estimates only.
- Photographs often do not reveal underlying structural or mechanical damage.
- A final, binding quotation can only be provided after a physical inspection of the vehicle at our premises in Mullingar.
- We reserve the right to amend any estimate if additional damage is discovered during the physical assessment or during the repair process. We will notify you of any significant changes before proceeding with further work.
3. Vehicle Repairs and Parts
We will carry out the repair work using reasonable care and skill. Where replacement parts are required, we will use parts that are suitable for the repair. If specific original equipment manufacturer (OEM) parts are requested or required, this must be agreed upon prior to the commencement of work and may affect the final quotation.
While we strive to match paint colours as accurately as possible using modern mixing technology, exact colour matches cannot always be guaranteed due to the natural fading and weathering of your vehicle's existing paintwork.
4. Payment Terms
Unless otherwise agreed in writing (such as direct billing to an approved insurance company), payment in full is required upon completion of the work and prior to the release of the vehicle. We accept major credit/debit cards and bank transfers. We reserve the right to retain possession of the vehicle until all outstanding invoices are settled in full.
5. Collection of Vehicles
Vehicles must be collected within a reasonable timeframe once you have been notified that the repair is complete. If a vehicle is not collected within 7 days of completion notification, we reserve the right to charge a daily storage fee, unless a prior agreement has been made.
6. Liability
We take all reasonable precautions to ensure the safety of your vehicle while it is in our care. However, we are not liable for the loss of or damage to any personal items left inside the vehicle. Please remove all valuables before leaving your vehicle with us.
Our liability for any damage to your vehicle caused by our negligence is limited to the cost of repairing such damage. We will not be liable for any indirect or consequential losses, including loss of use, loss of profits, or alternative transportation costs.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Your statutory rights as a consumer under Irish and EU law are not affected by these Terms. If you have a consumer complaint that we cannot resolve, you may refer it to the European Consumer Centre or the Competition and Consumer Protection Commission (CCPC).
7. Governing Law
These Terms shall be governed by and defined following the laws of the Republic of Ireland. The Body Shop Crash Repairs and yourself irrevocably consent that the courts of Ireland shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
